You are, imo.

You ask for a body. I showed you a body most all see.

As I said, we've taken the metaphor too far. That's not a body or the business world would be hopeless tied up in investigations every time any company missed sales. Missing sales does not establish that a crime has taken place any more than being broke establishes a robbery has taken place. Companies miss sales all the time without any crime involved. Many people are broke who have never been robbed. Intel missed sales last quarter, by your reasoning that indicates we need to prosecute AMD for it's criminal activity and I'm entitled to already claim they broke the law.
