i think you're interpreting it incorrectly. i think it means after the discovery the judge decides if a trial is necessary. later it says: "If the judge rules that a trial is required, the case will be decided by a jury in a federal district court In the U.S., a jury in federal court consists of six citizens..." So if there is a trial at all i think it's a jury trial. And it's been decided that there will a trial. at least that's my interpretation.
