I suppose so - for me, the key to the case was always a conspiracy to pilfer classified government databases. The rest of the stock stuff was just ancillary to the main crime.

Considering Royer would have been sentenced to a few decades for passing info to a foreign power, at least the judge agrees with the idea that Elgindy is not a crazed terrorist (which I never saw in the transcripts myself, but I didn't have my special Batman glasses on).
