Toxic Convertibles - Isn't that all part of naked shorting? Wasn't Valentine all about slamming companies down prior to the convert to profit multiple times? Isn't that what the SEC accused Rhino Advisors of? What happens when the convert never happens in a toxic convert? Do the fails created get settled promptly or slowly over time?

Now forgive me if I am wrong but...Was TK a company or part of Wall Street? Could the toxic raid occur if trades were forced to settle promptly? Does a company executive profit from a toxic convert other than raising capital to maintain operations?

Seems to me that all this rhetoric about companies being the scum is counter to the toxic convert argument as the lender in a toxic is in fact Wall Street.
