If Jobs "wasn't aware" of any illegality of the options grants back then, why did he return his?

"Hey guys, I think I'll just give back these 17 million tainted options that I'm sure are perfectly legit but would probably drag me down in the future. But you guys, keep helping yourself to all the tainted options you want- and I'll sign off on them."

How does that work, exactly? Is that like the mafia boss telling his thugs that he doesn't want to ride in the drive-by-shooting car this time, because he's been tipped off there will be a police detective standing nearby that might see him and tie him to that crime?
