Well, if from a strategic point-of-view it is damaging the national interests *more* then it is benefiting them to hold war prisoners in an off-shore locale in an effort to skirt American laws, I'd say the answer would clearly be 'yes'.

Presumably no one is much fond of gulags....

(And, since the global political harm seems to be fully acknowledged and increasingly obvious... and the CIA and others agencies have been reporting for a long time now that whatever tactical info these prisoners once held is long since dated and devalued... it would seem that this arrangement and policy is just another in a long line that has been crying out for a revaluation and new, more effective, tactics.)
