I doubt that I'd be making any such 'assumption'... especially without knowing what 'court' you are referring to!

(And, as far as the earlier example you gave, of field hearings adjudicating the fate of out-of-uniform German sabateurs [still being captured for some 2 to 3 years *after* the end of WW II, as I understand], I believe those hearings were FULLY in accord with Geneva convention requirements --- which only say that a captured insurgent needs to be accorded all the legal rights of a P.O.W. *until* there has been an adjudication by a 'competant tribunal' --- which could just be a few military officers holding a hearing in the field --- to determine whether the prisoner is indeed a 'P.O.W.', or not.)

I don't see where the international legal requirements have 'changed' from that point.
