The court overturned lower court decisions, and at least in part its own previous decisions (Ex parte Quirin and Johnson v. Eisenstrager) and ignored the fact that common article three of the Geneva conventions deals with "armed conflict not of an international character occurring in the territory of one of the High Contracting Parties."
