No bright line for the criminal here. I am not worried about whether or not dead people got punished enough. The question arises related to the survivors.

In this type of case a criminal could appeal the case and commit suicide in order to keep persons who were legitimately defrauded from recovering their losses and/or to leave a large estate to their off spring who would have had no rightful claim to the wealth otherwise. This seems unjust and is a separate issue than punishment for the perp.
