Tim, I am a Canadian. I am also an alien when I travel through the States. One of the great enticements for travelling in the States and enjoying a great land and a great people was the fact that I could indeed rely on the right to a presumption of innocence and the right to defend that innocence. The abrogation of this right is precisely the reason why I have NEVER travelled in (for instance) Turkey.

ACCUSING me of "waging war" does NOT mean I am guilty of the allegation; nor does it mean I am deserving of punishment. On the other hand (and I have already acknowledged this), countries actively involved in "war" may suspend certain rights for pragmatic reasons. My point was not that this latter may not be justified by expedience. My point was that it ought to be declared for what it is--a violation of the presumption of innocence and the right to confront your accuser--a violation predicated upon the exigencies of war.

Even though YOU (Tim) travel in England or France as an alien--you may rely (at this time) on the presumption of innocence while you dally about...
