Lou Lupin was adamant that Qualcomm will have no difficulty meeting the Supreme Court`s four pronged test for injunctive relief against Qualcomm. He also stated, for the first time I can recall, that Qualcomm doesn`t believe it needs any Nokia IPR to manufacture its MSM`s. By licensing Qualcomm`s portfolio, and paying millions of dollars in royalties, Nokia has admitted that it needs a Qualcomm license to sell its covered products. Should they fail to renew the license, wilful infringement would be beyond reasonable dispute, and injunctive relief would likely be granted. In efforts by Nokia to enjoin Qualcomm from selling chipsets, given that Qualcomm hasn`t paid Nokia royalties on the cross-licensed IPR, and Qualcomm denies that it utilizes their patents, Nokia would need to prove infringement before any appropriate legal and/or equitable relief could be fashioned.
It was clear that Lupin and Altman had their game faces on, and are gearing up to kick some Finnish booty for causing them (and the stock) such grief.The tone was decidedly more strident and resolute, and less collegial than in past conferences and statements. Nokia has picked this unnecessary fight, and has waged a disinformation campaign in the press. They started it, but Qualcomm is going to finish it.
