I don't thikn buyback is regulated like personal sales. They can buyback if they do it on regular intervals wihtout basis. If they said they would buy back 1M shares a week or 100k shares a day, then they could execut that plan and not get dinged.

It would not be a bad idea to take 5% of the monthly royalty revenue and just setup a regular buyback program which would over time completely remove them from the public market.
