Realistically, when high priced accountants/lawyers design "tax shelters" they are actively attempting to defeat the system in such a way that they bear no legal consequences. The ethical difference between legal and illegal schemes is sometimes that very technicality. There is often an equal hostility toward the system. Sort of like the difference between sinners and saints, as George Jones sang: "One is forgiven and the other one ain't"
