Exactly wrong. If you think so then you should stop paying taxes.

So you have bad tax law. Legislators trying to soak citizens of their hard earned money will always find their efforts thwarted by clever tax professionals. Why is the loophole not closed yet?

In the US we have the "Alternative Minimum Tax". It taxes people on the capital gains they avoided by donating appreciated property (and other classes of events). It was enacted to catch rich people who were not paying their "fair share". Now it is just another soak the middle class tax.
