disclaimer -- I have no legal background. I have never really followed any legal case to the level of detail I have followed the SCO case. I also know you have much more insight to this case then I do, but…

My instinct would be this strategy, “wear down an opponent by draining their financial resources”, is a “typical strategy” if you can’t get the other guy to settle and you are uncomfortable with the outcome of the case.

At this point I think IBM is comfortable they are well ahead in this case and are thinking more along the lines of using this case as a “don’t mess with us” demonstration.

For example, I don’t believe IBM is making settlement offers to SCO and SCO is turning them down. If IBM had doubt they were going to win they would exploit SCO financial position to force them to settle.

I don’t know all the specifics about the remaining SCO claims, but I can’t think of anything that could be in these claims that would result in a big pay day for SCO. It seems clear they do not have millions of lines of verbatim copying unix to linux. When I first started following this case I thought this is what SCO had. If they did, even if IBM could find ways to clear up/confuse the issue with BSD code or whatever I think IBM would be afraid of a Jury. But this does not seem to be the case.

What is the scenario you see SCO getting a big payday from a Jury in this case?
