The Court recognizes that as alleged by Broadcom, Qualcomm agreed to license its patents on FRAND terms, and is now refusing to honor this promise.


That depends on whether you read it as:
1) The Court recognizes the allegation is true.
- or -
2) The Court recognizes that this is what Broadcom has alleged

For the purpose of deciding whether there is a case, the Court assumes (for the moment) the allegations as stated are true. My reading is that of #2, and even if the allegation was true, that issue is not within the purview of that specific court.
