Whoever is in charge of the VA is taking an indefensible stance, but federal agencies don't tend to have the best lawyers, the pay isn't very good. The real litigators for the feds work for the Justice Department, and they get paid to play hardball, looking for every loophole, but eventually, when they get to court, they'll lose on the merits. Which will inflame the Religious Right, causing them to pour money into various coffers, and thrill the Anti-religious Left, causing them to pour money into various coffers. Americans United for Separation of Church and State will make money, and get their name in the news. And various pundits will pundify.
