It won't be a legalistic finding as much as a resonance with the people who know and admire an ethnic rainbow like Tiger Woods and no longer associate off-white tones with unelectability or second-class status at the highest levels. It's a different world from the Jesse Jackson approach to being black, which is the main point here, it seems to me. The term "post civil rights" era certainly comes to mind with Obama. JMHO.
