It was likely a stupid, preventable accident. It was stupid for the other person to run off - I doubt anyone would call it anything but an accident. As you note, he would have stood a better chance if he'd been wearing a helmet. It was ironic this happened right after we were discussing skiing, behavior of snowboarders and helmets right here on this thread. Hope you survived the latest blast from Mother Nature this weekend.
