The exact boundaries between the power as commander and chief, and the power to declare war have never been totally resolved, and perhaps never will be. Perhaps the founders didn't anticipate having large conflicts with no declaration, but they didn't explicitly forbid it. The courts have mostly not gotten involved on the issue. In the end the real checks on the president is the electorate, or perhaps in some cases the possibility of impeachment or defunding. But I don't think impeachment or defunding are likely, and Bush doesn't have to stand for election again and most likely Bush will be president for the next couple of years.
