Kouki puts the word murder in quotes, "The "Murder" of a Fetus". This means that the word murder is to be used in another way than the strictly legalistic one.

The crux of the discussion is whether you accept the use of the word unjustified as used in "... the unjustified killing of a human being with malice aforethought." By using unjustified you automatically accept the possibility of using justified in the same context. As in: The justified killing of a human being. There are numerous examples of the validity of this statement. State executions are one, civilian deaths during war are another. Since the law allows for abortions under certain circumstances then the word murder is incorrect in the context of abortions performed under the protection of the law.

From your source: "This section shall not apply to any person who commits an act which results in the death of a fetus if any of the following apply: 1. The act complied with the Therapeutic Abortion Act, Chapter 11 of Division 20 of the Health and Safety Code. 2. The act was committed by a holder of a physician's and surgeon's certificate as defined in the Business and Professions Code. 3. The act was solicited, aided and abetted and consented to by the mother of the fetus."

My conclusion is that Kouki is an agitator who seeks to draw those who are not very discriminating in their use of the English language into his anti abortion efforts.
