A "police state" is a big exaggeration. I'd agree its an exaggeration. Still there are millions of people in jail on drug charges so it isn't as big of one as you might think. Remember those guys with guns and $42K in their pockets are bad guys you legalizers want to put out of business by letting legit business take their market away. Wanting to open up the market to reduce the violence and secondary crime associated with it (or just for general libertarian reasons) is hardly equivalent to wanting to put the people in jail. The jail at least would at least be after a conviction, not punishment without a trial (and they aren't like POWs or illegal combatants either, so the arguments used in those cases don't apply)
