I don't think impaired judgement is going to provide much of a defense. It might be a mitigating factor or a lower crime (manslaughter or murder 2 instead of murder 1) but it won't be a get out of jail free card.

If it would be a major problem with currently illegal drugs, it would be a major factor now with alcohol, or for that matter with drugs that are illegal. Its not like they aren't available because they are illegal. We can't even keep them out of prisons, let alone out of the country.
