What prevents you from transferring a digital song out of an XM recorder and sharing it with millions of people worldwide without paying the RIAA its pound of flesh?

Efforts by the RIAA to control copying through analog means involved filtering out a portion of the audio spectrum but were rejected because people claimed they could hear the difference.

Nothing is keeping the RIAA from absolute control of "fair use".

Remember the Sirius USB PC adaptor that was hacked to save digital songs with track name, artist, and MP3 tags?

No one really cares about your definition of fair use if it can be used for piracy.
