Read the judge's opinion. She made it clear it was not a ruling on the merit of the RIAA's case, and only on whether there is a sufficient case to warrant a trial.

Not sure which opinion you are reading.. But, here is a direct quote from Judge Batts.

XM is both a broadcaster and a distributor but is only paying to be a broadcaster."

Which is exactly what the plantiff's complaint states.. LOL! For the life of me.. I don't know how you can make out the concept that the Judge MADE IT CLEAR it was not a ruling on the merit of the RIAA's case..

Maybe you could post the portion for about her making it clear it was not a ruling on the merit of the RIAA's case. After all.. She denied XM's motion to dismess? LOL!!

She went on to comment on XM's claim of protection afforded by the AHRA. Judge Batts continued...

"is not a wholesale, blanket protection for any and all conduct."

Somehow... I get the feeling that your understanding of this case is about the same as your knowldege of corporate bankrupctcies. Which appears to be ZERO.
