""A motion to dismiss under Rule 12(b)(6) requires the district court to accept the factual allegations in the complaint as true and make all reasonable inferences in the plaintiff's favor.""

LOL!! Now you are reciting Tort Law.. What does this have to do with your statement of:

Read the judge's opinion. She made it clear it was not a ruling on the merit of the RIAA's case, and only on whether there is a sufficient case to warrant a trial.

The above statement regarding Rule 12(b)(6) is not of the judge's opinion.

Please provide us the direct quotation from Judge Batts that led you to the conclusion that she made it clear that she was not ruling on the merit of the RIAA's case? You made this statement in a format in which suggested that I had not read the Judge's opinion. Yet, you now claim that Judge stated something that I have seen no proof of any such statements.

Yet, I have provided direct quotes for Judge Batts that directly prove that your statements were nothing more than more David Ray Lies. Which we all know you have a propensity to just make stuff up, and then present it as FACTS!

So we don't need you to recite Tort Law. So where is the statement where the Judge MADE IT CLEAR??

Do you have it? Or were you just making stuff up again, because it sounded good?

You are clueless. Always have been.

That pretty brazen talk from someone that has been pretty much 100% clueless about this case so far.. LOL!

Is it your self-importance complex that leads you to your extemporaneous and outrageous portrayal of the facts?

And so it goes,
