I don't think there was any flip-flopping.

The first day. Chairman Martin simply stated the FACTS!

That being that "current rules" prevents a single company from owning both SDAR licenses.

Then the next day, he was asked if the rule could be changed? Which of course the answer is YES.. Because almost any rule can be changed. Of course it takes months and months for the FCC to rule on any change requests. First there are NPRM's issued, followed by a Comment period, and then a reply to comments period. If you can get an NPRM issued and a rule change completed in two years.. You are doing pretty good. Then they asked him if anyone had petitioned to change the rule. In which, he replied no.

So the questions that were asked of him, were made so to paint a picture that is not exactly what the actual picture is. It is like asking someone. "Are you still beating your wife".. LOL!

Nothing would stop a merger if the merged entity agreed to give up one of their SDARS licenses. This happened quite frequently in when various Wireless Service Providers have merged over the years. The FCC OK'ed the mergers as long as certain overlapping spectrum licenses were either surrendered, or sold to a compeditive entity.

If all they want to do is combine operations and subscribers, and were willing to sell one of the SDARS licenses to a company that would provide competition.. Then I doubt the FCC would block such a merger.
