perhaps you could explain the following email exchange with "trades@datek.com" I have just received and clarify your "sixty second" rule.

Has anyone else had this "interesting" explanation of the 60 second rule?

Mr. Chapman,

The sixty second gaurantee begins to run from the work time, not the enter time. The work time on your order was 9:47:36. Your order was filled five seconds later, at 9:47:41.

I made a trade yesterday of XXXX ( 100 shares ). The tracking number was B-XXX-XXXX-XXXX this trade ( partial fill ) was entered at 09:34:39 and executed at 09:47:55.

Also can you explain why given your commision charging mechanism is
automatic it charges when it "knows" it was longer than 60 seconds?

Does someone really manually scan all trades to find ones in excess of
60 seconds and then credit the account?
