On the more general issue I think I agree with the blogger. The law shouldn't be set up to outlaw X technology, and allow Y technology. That's bad for the end user or third parties (who may have legitimate uses for that technology) and I don't think its really always good for the copyright holder, or for the interests the RIAA and MPAA are supposed to represent.

Instead the law should define what type of use is legal, and what type of use is illegal, and the exact technology you use to get that to that use shouldn't matter.

On the specific issue, I think I agree with you, I don't think its quite as cut and dried as you represent it, but I think your position (and XM's) is reasonable.

On the issue of the RIAA I largely agree with you. I'm not exactly one of their big fans...
