This abstract claims some nmda-blocking. So I suppose it's not impossible that it might have similar effects to memantine:

(But worth noting that all other NMDA blockers except for memantine failed for one reason or another - tricky pathway to mess with).

Your IP point is of course valid. But they presumably would at least get Waxman-Hatch exclusivity given that I don't think it is approved in the US for other indications.
