Maurice, Qcom did participate in the JVT but after the standard was "fixed" according to Qcom's reading of the evidence. Qcom then contends there is no evidence that it failed to disclose after it started participating. BRCM argued that Qcom did participate based on one email list, that actually was not a JVT email list but an MPEG list.

If the US govt mandaed cdma, then the Europeans would sue that such law violates the fair trade treaties that the US has signed. The problem is that the Euros use more subtle regulations to keep cdma out, such as deisgnating certain spectrum for 3G when back in 2000 cdma could have used the esiting spectrum.

I don't trust the Euro authorities one bit not to be biased against Qcom in order to protect Euro industry.
