Of course you can depending on volume and customer - equipment makers have done it all the time.
Even the volume discount can vary according to customer- Intel's volume discount from certain suppliers might be different than what AMD might get from the same vendor.


You can make it based on volume, but not by buyer or reseller. And according to the act, it can't be a first dollar discount or a cumulative one. Take a long read of the overview before making such claims.

If you make it be a x% discount for Y purchases, then everyone who bought Y amount or more, better get the x% discount. Else it is illegal.

And before you trot out the "its normal" argument, lots of people speed even though its illegal. A lot of people drive drunk too. I haven't heard of anyone not getting busted due to the "its normal" argument. And I don't think it would work, if you use it when you were caught doing 110MPH in a 25MPH residential district or a 15MPH school zone with lots of kids playing outside. I don't think even a "jury of your peers" would buy it either.
