Um. Haven't Gonzalez and Co. made exactly that argument repeatedly on W's behalf? WRT FISA, Gitmo, "extraordinary rendition", and all matter of other things that might not be consistent with a conventional reading of US law? Is somebody perhaps a bit irony impaired here?
