Aavid Thermal Technologies, Inc. Wins Patent Fight

U.S. Court of Appeals Upholds Lower Court Ruling

CONCORD, N.H.--(BUSINESS WIRE)--Sept. 30, 1997--Aavid Thermal Technologies, Inc. (Nasdaq:AATT) announces that the U.S. Court of Appeals for the Federal Circuit has affirmed Aavid's lower court summary judgment that declared a Thermalloy Inc. patent invalid. On August 22, a three-judge panel of the Federal Circuit unanimously affirmed the invalidity of the patent, because Thermalloy had impermissibly broadened its patent during reexamination. The patent at issue involved the cross-cutting of extruded aluminum to make heat sinks for microprocessors.

According to Aavid General Counsel John Mitchell, ``We're pleased that the Federal Circuit affirmed the lower court's ruling in favor of Aavid.

``Just as importantly, this decision demonstrates Aavid's commitment to protecting itself in the arena of intellectual property and proprietary technologies,'' Mitchell concluded.
