Perhaps you didn't read the Tragedy of the Commons.

The Niger tree example that you cited was a good example. When the trees were owned by "nobody" or the "government" they were treated as a commons. The results were as predicted.

When the trees were no longer treated as a commons the outlook improved. Private ownership of a tangible asset is one way to remove an item from being a commons. Not everything is so easy to assign an unchanging certificate of ownership. This is where rules and regulations are required to tame the commons.
