Not necessarily.
I might seem that way if you think private ownership is somehow permanent, but the reality is that in many cases private ownership is used as way to extract a short term value and then sell or abandon the property. An obvious example would be a mine, but it's done with all sorts of properties, think Love Canal.

In this case it is the ownership laws themselves that are being treated as a commons. The law is available to all, but those who take the most liberties with it reap rewards and leave the mess to others.
