We have held meetings with the staff of the FCC regarding this matter. On February 15, 2007, we received a letter of inquiry from the FCC relating to this matter. This proceeding may result in the imposition of financial penalties against XM or adverse changes to our repeater network resulting from having repeaters turned off or otherwise modified in a manner that would reduce service quality in the affected areas.

Mr. Ray kept trying to sell his story about how superior XM's space based coverage is compared to SIRIUS. Yet, XM has 300% more repeaters and some of those are operating outside the parameters originally outlined in their STA's. All of this just to attempt to get a decent signal to the consumer. How anyone can draw a conclusion that 300% MORE repeaters and some of those operating at higher power than originally sanctioned some how provides a superior space based signal is beyond me???

Just ask our friends up in Canada which service provides the best reception.
