Come on! You don't seriously thing that was an asset they were trying to keep- do you?

You actually make my point by constantly pointing out how legal it was at the time and how many lawyers Hooker had to write documents. The "law" is the real commons in this scenario. Various people and companies "take from the law" by getting it manipulated or by skirting it after it's made. In a nation of laws, the law itself is the largest common, and so the resulting tragedies come from the few taking more than their share from that commons.

Other kinds of societies have different commons, for example in communism it is the actual ownership of property that is common, as is the work-ethic, and their tragedies stem from the few taking from either the actual property or from their expected pool of labor (by not doing their job and taking a paycheck anyway).

As Hardin pointed out, every organization has something in common or it wouldn't be an organization, it would just be a collection of individuals. His point is that by recognizing what is common it is possible to tailor regulation of us, by us, to the area where it does the most to prevent a tragedy.

On the other hand, it is in the interest of those who exploit the commons most effectively to hide the nature of the common and their enthusiasm for exploitation.
