· On November 24, 2005, QUALCOMM filed a patent infringement lawsuit against Nokia in the U.S. Southern District of California (San Diego) asserting 11 Qualcomm patents and one Snaptrack patent supposedly bearing on ETI/3GPP GERAN technology.
· On May 24, 2006, Qualcomm filed a similar lawsuit against Nokia in the United Kingdom, as a geographic extension of the November 2005 lawsuit, filed in San Diego. Subsequently QUALCOMM filed similar actions in Germany, France, and Italy.
· On June 12, 2006, QUALCOMM filed a complaint with the U.S. International Trade Commission (ITC) against Nokia, alleging the infringement by Nokia on six of Qualcomm’s patents.

We believe these suits (QCOM litigation and NOK EU complaint) are part of the on-going negotiation process to seek leverage in ultimately reaching an agreement. These lawsuits are reminiscent of Qualcomm lawsuits in the late 1990s against Ericsson and Motorola (separately), which was ultimately settled and all claims/counterclaims dismissed. Note that Qualcomm’s current licensing agreement with Nokia expires on April 9, 2007.
