No one is definitely a terrorist until proven to be a terrorist.

This kind of thinking is what allowed 911 to happen. The Clinton Admin took a "law and order" approach to fighting Al Qaeda instead of a "war" approach. No one was "guilty" of attacking us in the 90's "unless we could prove it in a court of law."

In "war," a lesser standard is applied. Under the Geneva convention, all non-state actors are exempt from POW status. That includes all Taliban and Al Qaeda. They are irregulars. They are to be treated as terrorists. The solution to is to track down and kill all suspected terrorists world wide. Any captured are entitled to an immediate military tribunal, then a firing squad.

The people held at Git-mo should have been immediately interrogated, then tribunaled, their status established, and the ones that were found to be there by mistake returned to Afghanistan. The rest should have been put up against a wall and shot.

Until we take this approach, we will never win this long war.
