I agree. There should be no Gitmo. If someone was caught out of uniform fighting coalition troops, they should have been executed on the spot. In fact, I would imagine that most enemies who fought against coalition troops were either killed ASAP, or they escaped. It's hard to imagine a pause in some battle, and there side waves a stick with a white flag attached to it, and voila, ~200 "enemy combatants" successfully surrender, but I guess it did happen occassionally.

As for the people in Gitmo, we don't even know why they are there. They haven't been accused of any crime - we only know they were somehow captured somewhere and thought to be doing something against our various efforts. They may be alleged terrorist (we have to wait for the accusations against them to be made to know), but they certainly are not known terrorists.
