How do you know this? As far as I know the US has never released any criterion that got one sent to Gitmo as opposed to released immediately as opposed to jailed in Afghanistan and later released as opposed to anything. How do you know anything about the circumstances of their capture? This information, which as far as I know is completely unavailable, is one of the things that I am saying if they are going to be detained indefinitely, should be made available. How was it determined that they are a risk to the USA? It's not that outlandish of a request.

All of them are risks, all of them should be detained in absence of any substantial guarantee that any one of them will not return to the fight.

Well, you're a risk. We have no guarantee that you won't go somewhere and bomb Americans. None at all. Is that justification to lock you up indefinitely, without charge, other than someone, somewhere, somehow determined that you are a risk? Chew on that for a while.
