The timing of this lawsuit is more telling than the content. I suspect that Nokia is becoming increasing uncomfortable with their plan to no longer pay royalties to Qualcomm as of April 9th. By not paying royalties to Qualcomm while publicly stating that they recognize Qualcomm's patents as legitimate they open themselves up to punitive damages and possibly an immediate injunction against the use of those patents. By publicly stating they no longer believe Qualcomm's patents to be enforceable, which is a substantial change in their previous statements, they are justifying no longer paying royalties to Qualcomm. I suspect that they are filing this in the Europe because they feel that the European courts are more liberal and more likely to protect them than US courts.
