Do you think NOK is capable of filing a case seeking to declare what both parties already know to be true? Could the purpose of the case have more to do with public perception than legal point? If you know the matter will be settled one way or another prior to this case being resolved why not lop on anther dollop even if it did fall on the floor? In the meantime the home team gets grist for the mill.
