Rudi threw the Q a very large bone by determining that the conduct before the PTO was lawful. That is huge. The finding that Q had an obligation to obey an unwritten "rule" will certainly be appealed. QCOM's patents are valid. I'm not sure this will turn into a complete failure. QCOM will keep appealing this until the emotion and hype are boiled away and we are left with the law. What law requires adherence to unwritten expectations? The appeals will go on and on and the WCDMA market will grow and grow. Sad that BRCM won't have a license. Maybe they will make a whole bunch of money on their patent which saves power when cell phones are out of network. j.
