If he opts to let Qualcomm participate in the Patent Pool, Qualcomm may opt not to appeal, so as to not risk making bad law by appellate adoption of Brewster`s liability ruling.

The issue may be forced on Q if BRCM appeals the rejection of its inequitable conduct claim it lost.
