If Rudi orders Qualcomm to join the patent pool, I doubt they will file a Claim of Appeal. When one pursues appellate remedies, there is always the risk of making bad law. As a trial court decision, if not appealed, there is no binding precedential effect. At worst, it becomes weak precedent in the Southern District of California.If appealed, and affirmed, it becomes binding precedent in the Circuit, and important authority en other Federal Circuits where the issues haven`t yet been addressed.
