Surviving a motion to dismiss is "winning a key battle" only in the sense that they are still alive. It doesn't say anything about the strength of their case. Now they have to show evidence of confusion in the marketplace, not just wave their hands and claim it. The road gets much steeper for Tharos; I'm guessing Sepracor has a good shot at summary judgment.
