Boesky got a light sentence because he rolled over on other people. Its not clear that much of what Milken was blamed for was illegal or negative, although some of his activities may have been. Here is a rather one sided defense of Milken. I'm not suggesting its necessarily correct, only using it to point out that there is another side to the story.

I'm not totally sure about the Winnick case. Since he wasn't charged with a crime I'm not sure what crime he allegedly committed. He did operate the company to his own benefit more than the benefit of the shareholders. I'd agree that's wrong but I'm not sure if he committed a specific crime. Then again I'm not sure he didn't. I don't know enough about the case. A quick google search came up with the idea that he didn't disclose pertinent negative information about the company but traded on it instead, so there may be violations of insider trading laws, and also failure to comply with reporting regulations. So maybe he did get away with crimes (then again so do some 7/11 robbers)

But yes some people who committed serious and unambiguous white collar crimes either got away with it or received slaps on the wrist. I do think things are moving away from that practice though. In some ways this change is positive, serious "white collar" crime should receive serious punishment. In other ways the change is negative. SOX regulations are expensive and burdensome, and also you may get people who are made examples of, more than consistent punishment for clear crimes.
