The quarterly payment in advance is essentially a way to avoid an injunction or intentional infringement.

I think that is exactly what this move is designed to do....which is why I wonder if Qualcomm will do something similar. One problem is that Q is likely to have to pay for all of the WCDMA chipset shipments since they go to countries where Nokia has patents.

FWIW, I dont think that anybody should be surprised by Nokia's low-ball offer. The Goodman-Myers report that they love says that Qualcomm has 30 out of the 157 patents that are considered essential. Take out a few patents that are "paid up" and then calculate the percentage based on a 5% cap....and then take out the sales that are in countries where Q hasnt filed for patents and you are likely to get close to that $20 million dollar payment.
